Terms of Service

WeshareTrip (the "Service", published by ELEOR, "we") is a collaborative platform that lets a group organize a trip: itinerary and activity planning, group polls, group chat, expense tracking and splitting, packing lists, document sharing, a photo gallery, and an exportable printable trip souvenir.

WeshareTrip is not a travel agency. We do not sell or book any travel service (tickets, accommodation, activities) and are not registered as such. Figures provided by the Service (budget estimates, weather forecasts, exchange rates) are indicative, computed from public data or third-party providers, and never constitute a commercial offer.

By creating an account or using the Service, you accept these Terms without reservation.

1. Access to the Service

• You must be at least 15 years old to create an account (digital age of consent under French law). Minors under 15 must obtain consent from a holder of parental authority.
• An account is created with a username, email address, and password. You are responsible for keeping your credentials confidential and for any activity carried out from your account.
• You can join an existing trip via an invite link without necessarily creating a registered account ("quick add" invitation).

2. Service features

Once registered, you can in particular:

• Create and manage trips: destination, dates, budget, members.
• Plan activities, vote in polls, and chat with your group.
• Record and split expenses between trip members.
• Build a packing list and share documents (tickets, bookings).
• View a 5-day weather forecast and indicative exchange rates.
• Generate a printable trip souvenir ("Trip Keepsake") and share photos.

3. Plans and pricing

Every trip starts on the Free plan (free, up to 5 members). Two paid plans increase the capacity of a given trip:

Important: this is not a recurring subscription. Each paid plan is a one-time purchase, per trip, valid for the entire duration of that trip. Prices shown above are those in effect as of [date] and may change; the price shown at the time of purchase applies.

4. Additional purchases

Independently of a trip's plan, two one-time purchases are available:

• Trip Keepsake (a printable PDF souvenir of the itinerary, budget, and photos): one-time purchase per trip.
• Photo pack: extends a trip's photo storage space, one-time purchase.

5. Referral program

You can invite others to create an account via your personal referral link. Every [number] successful referrals earn you a free Trip Pass credit, usable on a trip of your choice. Exact conditions (threshold, credit validity) may change and are viewable in your Account settings.

6. Payment and right of withdrawal

Payments are processed by our providers Stripe and PayPal, each of which has its own terms of use. WeshareTrip never stores any payment card data.

Under Article L.221-18 of the French Consumer Code, you generally have a 14-day right of withdrawal on any purchase made at a distance (plan, keepsake, photo pack). However, as this is digital content/service delivered immediately after payment, this right of withdrawal expires as soon as delivery begins, provided that, before paying, you have:

• expressly requested immediate access to the service, without waiting for the 14-day period to end; and
• expressly acknowledged losing your right of withdrawal once the service is fully delivered.

This consent is collected through a positive action on your part at the time of payment (an unchecked box you must actively check) — under Article L.221-28, 13° of the French Consumer Code, a box pre-checked by us would not be a valid waiver. If you did not give this explicit consent, you retain your 14-day right of withdrawal.

Outside this legal framework, purchases are final, except for an exceptional commercial gesture granted at our discretion (contact us).

7. User Content

7.1 Ownership and license granted

You retain ownership of any content you publish on the Service (itineraries, messages, photos, documents). By publishing it, you grant us a non-exclusive, royalty-free, worldwide license, limited to what is strictly necessary to operate the Service (technical hosting, display to the members of the relevant trip, generating your Trip Keepsake if you order one). This license ends as soon as you delete the content or your account, subject to content shared with other members who have not done the same on their side.

This license covers only the economic rights necessary to operate the Service. Under Article L.121-1 of the French Intellectual Property Code, an author's moral rights — the right of attribution and the right to the integrity of the work — are perpetual, inalienable, and imprescriptible: they can never be taken from you or transferred, including under these Terms.

7.2 Responsibility and third-party rights

You are solely responsible for the legality of this content and warrant that you hold the necessary rights to publish it — including, for photos and documents involving third parties who are not Service members, their consent under image rights (droit à l'image) and the GDPR. WeshareTrip does not systematically pre-review published content.

7.3 Reporting and removal of illegal content

Under Article 16 of Regulation (EU) 2022/2065 (Digital Services Act) and Article 6-I-5 of the French LCEN, any user can report content they believe is illegal to [email protected], specifying: the content concerned (link or location in the app), the precise grounds for the report, and your contact details.

After review, if we remove or disable access to content, we will inform its author, with the grounds for the decision and the remedies available (contest by replying to our email), under Article 17 of the same Regulation. In the event of repeated, clear breaches of these Terms, we may suspend or terminate access to the Service, after a prior warning except in cases of urgency (manifestly illegal content).

Note: as a micro-enterprise under Recommendation 2003/361/EC, WeshareTrip benefits from the exemption in Article 19 of the DSA for the heaviest obligations (internal complaint-handling, trusted flaggers, etc.), but remains subject to this minimum baseline applicable to all hosting providers.

8. Indicative nature of estimates

Weather forecasts, exchange rates, and budget estimates shown in the Service come from third-party data providers (weather services, reference exchange rates). They are provided for information purposes only, create no contractual commitment on our part, and should be verified against official sources before any decision that depends on them.

9. Account deletion

You can delete your account at any time from your settings. This action is irreversible and has the following effects:

• Free trips you own alone are deleted, along with their activities and expenses.
• Paid trips (Trip Pass/Collective) you own alone are kept, not deleted — contact us if you'd like a refund.
• Shared trips are transferred to another member; your name is removed from expense splits you're part of elsewhere.

10. Liability

The Service is provided "as is". We do not guarantee uninterrupted availability and disclaim liability for indirect damages resulting from its use. Where our liability is engaged, it is limited to amounts you actually paid us over the preceding 12 months.

11. Changes to these Terms

We may amend these Terms at any time. Material changes will be notified to you by email or via the Service. Continuing to use the Service after notification constitutes acceptance.

12. Governing law and jurisdiction

These Terms are governed by French law. Any dispute will be submitted to the courts of ELEOR's registered office ([city]), subject to the right of consumers residing in the European Union to also bring proceedings before the courts of their own country of residence.
